By accessing or using Minute Listing (“https://minutelisting.com”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including visitors, registered users, and subscribers.

Minute Listing is an AI-powered content generation tool for real estate professionals. The Service generates marketing content including MLS descriptions, social media captions, email drafts, and video scripts based on property details you provide. The Service also offers optional social media publishing features that connect to third-party platforms.

You must be at least 18 years old and have the legal authority to enter into these Terms to use the Service. By using the Service, you represent and warrant that you meet these requirements.

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@minutelisting.com if you suspect any unauthorized use of your account.

The Service is offered on a subscription basis. Subscription fees are billed in advance on a monthly basis. All fees are non-refundable except as required by law. New users may receive a free trial period as described during sign-up; after the trial, your chosen plan will automatically begin billing.

We reserve the right to change our pricing at any time. We will provide at least 30 days' notice before any price change takes effect for existing subscribers.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Violate the Fair Housing Act or any other fair lending or anti-discrimination laws
• Generate, publish, or distribute content that is false, misleading, defamatory, or fraudulent
• Attempt to reverse engineer, scrape, or extract data from the Service
• Share your account credentials with others
• Use the Service to spam or send unsolicited communications

Content generated by Minute Listing is produced by artificial intelligence and is provided as a starting point only. You are solely responsible for reviewing, editing, and approving all content before publishing or submitting it to any MLS, social platform, or other channel.

Minute Listing does not guarantee that AI-generated content is accurate, complete, compliant with Fair Housing laws, or suitable for your specific listing. You must review all content for accuracy and compliance before use. Minute Listing is not liable for any errors, omissions, or violations in published content.

The social media publishing features connect to third-party platforms (including Meta, TikTok, and LinkedIn) through their respective APIs. By using these features, you authorize Minute Listingto post content on your behalf to those platforms. You remain solely responsible for all content published through the Service.

You must comply with the terms of service of each social platform you connect. Minute Listing is not responsible for any actions taken by third-party platforms, including suspension or removal of your accounts.

You retain ownership of the property details and original content you provide to the Service. You grant Minute Listing a limited license to process your input to generate content and provide the Service.

The Minute Listing platform, branding, software, and underlying technology are owned by Minute Listingand protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MINUTE LISTING DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINUTE LISTING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Minute Listing and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion, with or without notice. You may cancel your subscription at any time through your account settings or by contacting us at support@minutelisting.com.

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Florida.
